The Council recommended the Shoremaster to advertise the lease of the houses, offices and gardens at Footdee occupied by Mrs Urquhart, which had been purchased from James Thomson's Trustees. The Council authorised the Shoremaster and the magistrates, or any three of them, to apply to the Sheriff to name a jury for valuing the following properties: the garden at the Lime Quay belonging to Provost Leys; the houses at Footdee, called the Foundery, belonging to Messrs Forbes and Hogarth; and any other properties within 150 yards of the flood mark necessary for the improvements to the harbour, in terms of the Act of Parliament of 37 GEO. The Council agreed to accept the resignation of Mr David Morice, advocate, from the post of Assessor or Consultor. The Council fixed 22 January 1806 for a meeting to elect a person to succeed Mr Morice as Assessor. The Council voted their thanks to Mr Morice for the zeal, abilities and attention displayed in the Town's service. (226v)

The Council enacted that all persons who cast out ballast from any vessel onto any of the quays or piers in the Harbour, were responsible for ensuring that the ballast was removed to a place designated by the magistrates and Council or by the Berthmaster; offenders against the Act were to pay a penalty of 40 shillings. The Council ordered that the eighth article of the Table of Regulations for the Berthing of Ships, dated 12 May 1786, be amended to include this Act of Council. (226v - 227r)
