Description | Petition states that "James Will, Sailor in Stonehaven has been guilty of a breach of the peace and of committing an assault upon George Garthwaite, Master of the Jason of Sunderland presently lying in the harbour of Stonehaven. In so far as upon Tuesday 28th of February immediately by past betwixt the hours of two and three o'clock in the afternoon, or at some other time of the said day, while the said George Garthwaite was standing quietly on the pier or quay of Stonehaven, he the said James Will complained upon, without any provocation, seized hold of him violently and turned him round, pushed him several times on the breast, threatened to knock him down, and would have injured him severely, if he had not been prevented by two men who laid hold of him, whereby the said James Will has been guilty of an unprovoked assault on the said George Garthwaite and of a gross breach of the peace and ought to be severely punished to deter others from committing the like in time coming." The fine is 20 shillings sterling to the complainer as well as the cost of the application and procedure to follow, also asks to "grant warrant for levying the same by distress, pounding or imprisonment, and also to grant warrant for citing witnesses.
