TitleStonehaven Burgh: Complaint James Rhind Shore and Berthmaster Stonehaven & Procurator Fiscal thereof & John Alexander Shipmaster
DescriptionIn two parts. 1. Petition that states: "by the regulations and practice observed in the harbour of Stonehaven vessels coming in to it are entitled to berths at the quay for unloading their cargoes according to the order in which they come into the harbour. That yesterday the two berths at the quay were occupied by a vessel unloading lime and another discharging coals. That several other vessels lay in the harbour with cargoes to be discharged. That of the vessel called the Good Intent of Stonehaven belonging to and commanded by John Alexander Shipmaster there was entitled from her priority of arrival to the first vacant berth at the quay, and the vessel called the Isabella belonging to and commanded by James Cormack being next in order of arrival was entitled to the second vacancy. That without waiting till a vacancy occurred at the pier the said John Alexander sailed with his vessel from the harbour of Stonehaven in order to discharge his cargo at another port. That in consequence of his departure the first vcant berth fell to the vessel belonging to James Cormack. That the said John Alexander having however by unfavourable winds or some other cause returned again to the harbour he insisted on being still enitled to resume his priority although it was evident that from being now the last arrived vessel in the harbour he was bound to wait for the last turn at the quay." 2. Declaration of Defender, Minutes & Interlocutor in James Rhind Shore & Berthmaster of Stonehaven and the procurator fiscal thereof and John Alexander, dated 31st May 1805.
